Divorce-Can One Spouse Prevent A Divorce?

The prevention of a divorce depends on the state reading divorce where the couple resides.

Divorce laws generally can be classified no-fault divorce laws and divorce laws with guilt. The fault divorce laws provide a list of legal reasons or justifications for granting a divorce. Specific causes are described in the law, but typically include adultery, cruelty or neglect.

The laws do not require fault (“no fault”) only require that the couple has irreconcilable differences. If a person wants a divorce, but her spouse if residing in the state and do not need guilt, opposed to divorce a spouse can not stop the divorce.

In fault states, a spouse can prevent a fault divorce after convincing the court that he or she has no guilt. This should be proven in court and for the judge to decide.

There are other ways of defending a divorce in states that require guilt. Examples include:.

-Cancellation: If a person tolerates or accepts sex outside of marriage and your spouse asks for a divorce or her infidelity, spouse infidelity accused may challenge the Save The Marriage divorce decree, arguing that the first party knew of the matter and consented to the action.

-Collusion: This defense is creating a situation for the other person commits an act to risk marriage. For example, if a woman creates an opportunity for her husband is in a situation where he is alone with her lover. This arrangement is known as to incite a divorce and is an argument that can be done in court to defend their actions.

-Provocation is the inciting of a spouse to do a certain act. If a spouse suing for divorce and claims that the other spouse abandoned the other can defend his claim, as they were caused by neglect.

-Collusion happens when a couple lives in a state where the divorce requires separation of the couple for a while and the couple did not want to prolong the situation. This can lead the couple to deceive the court and pretend that one of them was at fault just to get out of marriage.

These defenses are rarely used for several reasons. First, demonstrate a defense may require witnesses and a lot of time and expense. Second, these efforts usually do not contribute to the situation, and it is likely that a court finally granted the divorce.

A person should not have to stay married if you do not want. The law is designed to give people the opportunity to leave the marriage if that is what he or she really wants to do. If you are in a marriage to be terminated, the process can be difficult but not impossible.
